www.emky.pl shop guarantees orders with no visible or hidden defects. An exception might be a product with a precisely described defect or flaw, which is sold on sales.

In case of product defects which are found after completing the order, there are two complaint methods for the buyer:

  • Guarantee claim
    It is investigated by the guarantor indicated in the warranty card of a given product, if it was issued. The guarantor can be mainly a distributor, manufacturer or, in case of importing the goods from beyond the European Union, its importer. The guarantee duration, terms and conditions are always given in an accompanying warranty card. In case of products for which the guarantor did not issue a warranty card, the guarantee duration, terms and conditions are included in the guarantee declaration issued by the guarantor, formulated in a widely comprehensive form, mostly in the form of a document, website information or advertisement.
  • Warranty claim
    It is used in situations when the purchased product appears to be non-compliant with the contract concluded with the seller. The basis for handling such a complaint is detecting the product defect before the period of two years has expired, counting from the date of goods delivery to the client. The warranty claim expires after a year, however this period cannot finish before two years pass after the date of goods delivery.

What is the complaint procedure?

1 Selecting a complaint method: guarantee claim or warranty claim.
2 / Contacting EMKY team: lodge the complaint in a convenient way, eg. via e-mail to office@emky.pl; enter the word “complaint” in the message title.
The fastest way to lodge a complaint is to send a complaint form (
sample form) via e-mail to the address: office@emky.pl.
3 / Documentation: send us photographic documentation with a description, and, if needed and after consulting the EMKY team, also the returned product.
4 / Diagnosis:EMKY team will process your claim.
5 / Decision:requires obtaining necessary documentation or, if necessary, the returned product.However, we undertake to inform you whether the complaint has been acknowledged via e-mail or phone within 14 calendar days from the date of receving the complaint.

The goods being the subject of the guarantee claim should be sent together with a printed form to the following address:

Important!
If, after consulting the EMKY team, it is necessary to deliver the product in question, please send also its whole equipment. It may be indispensable for servicing procedures. Please also remember about the proof of purchase, e.g. a receipt or invoice. This will speed up the whole complaint process.

The guarantee covers:

  • products in which defects have been detected during use,
  • products whose descriptions on www.emky.pl website do not comply with the actual condition,
  • incomplete orders – in such cases an additional shipping of the missing products is organised. The cost of delivery is incurred by www.emky.pl shop.

Amicable settlement of disputes:
As a consumer, you have a right to have recourse to an out-of-court complaint and redress mechanism by:
